बजेटमा बारुदी सुरुंग तथा विष्फोटक पदार्थहरुबाट पीडितहरु तथा सवै खालका अपांगता भएका व्यक्तिहरुको सेवा, सुविधा र अधिकार
बारुदी सुरुंग प्रतिवन्ध अभियान नेपालका २०७७ असार ४ गते बजेटमा बारुदी सुरुंग तथा विष्फोटक पदार्थहरुबाट पीडितहरु तथा सवै खालका अपांगता भएका व्यक्तिहरुको सेवा, सुविधा र अधिकार बिषयमा छलफल कार्यक्रमको आयोजना गर्यो । उक्त विषयमा छलफल गरी प्रस्तुत भएका निश्कर्षहरुबाट हामीले सरकारको ध्यानाकर्षण गरेकाछौं । पीडीत सहायताको लागि कार्यगरिरहेकाहरुकाहरुको निम्ति यी निश्कर्ष उपयोगी हुनेछन् भनी जानकारी गराएकाछौं । धन्यवाद ।
कोभिडको विरुद्धको खोपमा अपांगता भएका व्यक्तिहरुलाई प्राथमिकतामा राखियोस र खोप दिने स्थान अपांगमैत्री होस ।
- बारुदी सुरंग र विष्फोटक पदार्थ र व्दन्दबाट अपांगता भएका व्यक्तिहरुले जीवन पर्यन्त औषधी सेवन र उपचार गरिरहनु पर्ने भएकोले सोको व्यवस्था निशुल्क उपलव्ध गराईयोस ।
- अपांगता भएका व्यक्तिहरुले सहायक सामाग्री सहज रुपले नपाउने हुनाले सो सामाग्री सहज र निशुल्क उपलव्ध गराईयोस ।
- कृतिम अंगहरु निशुल्क र सहज रुपले उपले उपलव्ध गराईयोस । यो फेर्नु परिरहने हुनाले आवश्यकता अनुसार उपलव्ध गराईयोस ।
- सन् २००६ को बृहत शान्ति सम्झौता पछि पनि व्दन्दकालमा विछ्याईएका बारुदी सुरुंग र विष्फोटक पदार्थहरुबाट लगातार रुपमा विष्फोटनका घटनाहरु हुने, सर्वसाधारणहरुको मृत्यु र अंग भंग भईरहेकाछन् । तर सरकारले सन् २००६ सम्मका व्दन्दवाट अपांगता भएका व्यक्तिहरुलाई मात्र सेवा, सुविधाको व्यवस्था गरेको हुनाले आईन्दा २००६ पनि व्दन्दको कारणबाट अपांगता भएका व्यक्तिहरुलाई सेवा तथा सुविधा उपलव्ध गराईयोस ।
- बारुदी सुरंग तथा विष्फोटक पदार्थहरुबाट घाईते र व्दन्दवाट अपांगता भएका व्यक्तिहरुमा आर्मी, प्रहरी र तत्कालिन विद्रोही पक्षले सरकारबाट जीवन निर्वाह भत्ता स्वरुप नियमित तलव पाउने गरेकाछन् । व्दन्दसित कुनै सरोकार नराख्ने सर्वसाधारणहरु अनाहकमा अपांगता भएकाहरुले पनि सो सुविधा अनिवार्य पाउनु पर्दछ । कुनै विभेद नगरी सो दिलाईयोस ।
- बारुदी सुरुंग तथा विष्फोटक पदार्थको कारणबाट अपांगता हुँदा रोजगारी र व्यवसाय गुमाउनु पर्दा सर्वसाधारणहरुको आर्थिक जीवन खस्केकोछ । उनीहरुको लागि उचित आर्थिक उत्पादन गर्ने व्यवसाय र रोजगारीको व्यवस्था गरियोस ।
- बारुदी सुरुंग तथा विष्फोटक पदार्थहरुबाट अपांगता भएका तथा व्दन्दपीडितहरुको परिचय पत्रको व्यवस्था गरियोस । परिचय पत्रको आधारमा उनीहरुलाई सेवा र सुविधा उपलव्ध गराईयोस ।
- अपांगता भएका व्यक्तिहरुलाई चार वर्गमा छुट्याएर रातो, नीलो, पहेंलो र सेतो कार्ड वितरण गरेर रातो कार्ड पाउनेहरुलाई मात्र सामाजिक सुरक्षा भत्ता उपलव्ध गराउने गरेकोमा अपांगता भएका व्यक्तिहरुको दवावमा प्रधानमन्त्रीको ठाडो आदेशमा नीलो कार्ड भएकालाई पनि सामाजिक सुरक्षा भत्ता उपलव्ध गराईयो । अपांगता भएका व्यक्तिहरुलाई व्यक्तिको निगाहावाट भन्दा पनि कानूनव्दारा सामाजिक सुरक्षा गर्ने व्यवस्था गरियोस ।
- भौतिक संरचनाहरु अपांग मैत्री बनाईयोस । यस विषयमा केन्द्रदेखि स्थानिय सरकारहरु सवै क्षेत्रले लागू गरियोस ।
- अपांगता भएका व्यक्तिहरु सवालमा केन्द्रिय बजेटले सम्बोधन गरे पनि धेरै जसो स्थानीय सरकारहरु अपांगता भएका व्यक्तिहरुको लागि बजेट छुट्याउनु पर्ने आवश्यकता बारे अनभिज्ञछन् । उनीहरु विच सचेतना होस र स्थानीय तहमा पनि यथेस्ट बजेटको व्यवस्था गरियोस ।
- संविधानले दिएको अपांगता भएका व्यक्तिहरुको सेवा, सुविधा र अधिकारको प्रवर्धन गर्नको निम्ति वजेटले अपांगता भएका व्यक्तिहरु सवालमा सम्वोधन गरे पनि वजेटको आकारमा ०.९ प्रतिशत जति मात्र छुट्याईनेले समग्रमा अपांगता भएका व्यक्तिहरुको समस्या समाधान गर्न पर्याप्त छैन । बजेटको आकार बढाउनु जरुरीछ ।
- विभिन्न आयोग र मन्त्रालयहरुका अपांगता भएका व्यक्तिहरुको सेवा, सुविधा र अधिकार संरक्षण गर्नको लागि योजना, वजेट विनियोजन र प्रभावकारी ढंगले लागू गरियोस ।
- बारुदी सुरुंग प्रतिवन्ध सन्धी (ओटावा सन्धी) मा नेपाल सरकार सिघ्र प्रवेश गरियोस । ओस्लो कार्य योजना अनुसार पीडितहरुलाई सहायता गरियोस ।
- पीडितहरुको दीगो सहायताको लागि व्यक्तिको दया, माया भन्दा पनि संवैधानिक, नीतिगत र कानूनी प्रकृयाबाट सेवा, सुविधा प्रदान गर्ने र अधिकारको सुनिश्चिता गरियोस ।
साथै सरकारको यस बर्षको बजेटले अपांगता भएका र व्दन्दपीडित व्यक्तिहरुको लागि उल्लेख गरिएका निम्न बुँदाहरुलाई समाबेस गरेकाछौं ।
The Landmine Ban Campaign of Nepal (NCBL) organized a discussion program on "Budget: services, facilities and rights of the victims of landmines and explosives and people with all kinds of disabilities" on 18 June 2021. We have drawn the attention of the government from the findings presented after discussing the issue. We forward these findings that may be useful for those working on VA assistance. Thank you.
1. Priority should be given to persons with disabilities in vaccination against covid -19 and the place of vaccination should be disability friendly.
2. People with disabilities from landmines and IEDs need to take medicine for a long time and to check regularly. The government should provide these facilities free of cost.
3. As people with disabilities do not have easy access to assistive devices, they should be provided easily and free of charge.
4. Prostheses should be provided free of cost and easily. As it needs to be replaced, make it available as needed.
5. Even after the Comprehensive Peace Agreement (CPA) of 2006, civilians including children became victims from landmines and explosives. The government is providing services and facilities only to the persons with disabilities due to the conflict from 1996 to 2006, services and facilities should be provided to the persons with disabilities who became victims after CPA due to abandoned explosives from the ten year conflict.
6. People in army and police services injured by landmines and explosives and disabled during the conflict have been receiving regular salaries from the government. The rebels are receiving subsistence allowances by the government. The civilian survivors who were not part of that conflict, are not getting that facility. The facility should be given to all civilian victims without any discrimination.
7. The survivors of landmines and IEDs lost employment and business and deterioration of their economic life. Arrangements should be made for them to have proper economic development and employment.
8. Arrangement should be made for the identity cards of the people with disabilities due to landmines and explosives. Services and facilities should be provided to them on the basis of identity cards.
9. By distributing red, blue, yellow and white cards to the persons with disabilities in four categories and providing social security allowance only to those who get red cards, under the pressure of the persons with disabilities, social security allowance was also provided to those with blue cards by the prime minister. Provision should be made for the social protection of persons with disabilities by law rather than the care of individuals.
10. Physical structures should be made disability friendly. In this regard, local governments should also be responsible as well as the central government.
11. Although the central budget addresses the issue of persons with disabilities, most local governments are unaware of the need to allocate budgets for persons with disabilities. There should be awareness among them and the adequate budget should be allocated at the local level as well.
12. Although the budget addresses the issue of persons with disabilities to promote the services, facilities and rights of persons with disabilities on the basis of guidelines of the constitution, allocating around 0.9 percent in the size of the budget is not enough to solve the problem of persons with disabilities as a whole. It is necessary to increase the size of the budget.
13. The Government of Nepal must accede to the Mine Ban Treaty (Ottawa Treaty) immediately and assist the victims as guided by Oslo Action Plan.
14. To provide services, facilities and protect and promote the rights of persons with disabilities various commissions and ministries should make proper plans, budget allocations and implement effectively.
15. To provide services, facilities and protect and promote rights of survivors through the constitutional, policy and legal process rather than the kindness and love of the individual for the sustainable victim assistance.

Social security and protection
78. I have increased the amount of child protection grant provided to the children… of disabled and deprived families by one third.
80. Feasibility study will be done for the establishment of disability rehabilitation centers in all the states. Treatment services for children with intellectual disabilities will be made easy and effective. I have given continuity to the arrangement of providing grants to the organization producing the accessories used by the persons with disabilities. Public physical infrastructure, infrastructure and means of transportation will be made disability friendly.
Women, children and senior citizens
86. Programs for income generation, capacity building and empowerment of women and adolescents ….with disabilities will be conducted.
Quality education:
213. Disaster sensitive and disability friendly educational infrastructure will be constructed.
223. I have allocated a budget for scholarships to protect the right of …persons with disabilities to education.
224. Arrangements will be made for the blind children to get education with the help of modern technology including Braille textbooks. One special school will be established in each state with accommodation facilities for the students with intellectual disability.
Law and justice
386. The free legal aid program operated in 47 districts for …the disabled persons who do not have access to justice will be extended to all the districts in the coming Fiscal Year. I have made an arrangement to advocate on behalf of the victims in all the districts of the country.
390. Support, respect and protection will be provided by documenting all the people's movements, armed struggles and martyrs' families who have sacrificed their lives during the revolution for the advancement of democratic change in Nepal, the families of the disappeared, the warriors of democracy, victims of conflict and displaced persons with disabilities. People affected by armed conflict will be encouraged to become self-employed by providing soft loans.
